IRS Disabled Access Credit FAQ

The IRS Disabled Access Credit (Section 44) lets eligible small businesses claim a non-refundable tax credit for 50% of qualified accessibility expenses between $250 and $10,250 per year—up to $5,000 annually. It does not lower the invoice from your vendor; you claim it on your federal return. For example, if you spend $2,500 on remediation, you may reduce tax liability by $1,125 (50% of the amount over $250)—again, only if you qualify.

Eligibility is limited: your business generally needs $1 million or less in gross receipts or 30 or fewer full-time employees in the preceding tax year. Many small businesses meet that bar, but mid-size and larger companies often do not. Website accessibility remediation can count as a qualified expense when you qualify. Consult your CPA or tax advisor—don’t assume eligibility from our pricing page alone.

You claim the credit when you file your annual federal tax return using IRS Form 8826, Disabled Access Credit. The credit applies to expenses incurred during that tax year. Keep receipts and documentation of your accessibility work for your records.

The Disabled Access Credit is non-refundable, meaning it can reduce your tax liability to zero but won't result in a refund. However, unused credit can be carried back one year and forward 20 years, so you may still benefit in future tax years if your liability is low this year.

Yes. The credit applies to each tax year. If you spend money on accessibility improvements (including ongoing monitoring, new page remediation, or annual audits) in a given year, you can claim the credit for that year's qualified expenses—up to $5,000 per year.
